Data Processing Addendum

  1. Roles of the parties

    For customer data processed through Decision-APM, the customer is generally the Controller and Sinais LLC acts as Processor, except where Sinais LLC determines purposes and means of processing under applicable law.

  2. Processing instructions and scope

    Sinais LLC processes personal data only as necessary to provide and support Decision-APM, in accordance with the customer agreement, documented instructions, and applicable law.

  3. Security measures

    Sinais LLC implements appropriate technical and organizational measures designed to protect personal data against unauthorized access, disclosure, alteration, and destruction.

  4. Subprocessors

    Sinais LLC may engage subprocessors to deliver services. Current subprocessors are listed at /subprocessors. Sinais LLC ensures contractual data protection obligations flow down to subprocessors.

  5. International transfers

    Where personal data is transferred internationally, Sinais LLC relies on appropriate safeguards, including Standard Contractual Clauses (SCC) and equivalent lawful transfer mechanisms, where applicable.

  6. Data subject requests and assistance

    Sinais LLC provides reasonable assistance to customers for responding to data subject requests and regulatory inquiries, consistent with the nature of processing and available information.

  7. Incident notification

    Sinais LLC will notify affected customers without undue delay after becoming aware of a confirmed personal data breach impacting customer data, as required by applicable law and contractual commitments.

  8. Return and deletion

    Upon termination of services, customer data is returned or deleted in accordance with the customer agreement, retention obligations, and applicable law.
